Terms of Service & SMS Terms

1. Agreement
These Terms govern your use of LatchCRM.live, operated by Latch the Company LLC ("Latch," "we," "us"), including services used by insurance agency teams and visitors who request information through our forms. By using the site or messaging program, you agree to these Terms and our Privacy Policy.
2. The service
LatchCRM.live is a multi-tenant CRM for insurance agencies (including mortgage protection and final expense workflows). Features may include lead pipelines, calling, SMS, email drafts, commissions tooling, and a client policy portal. Access for agencies is typically invite- or subscription-based. We may change, suspend, or discontinue features with reasonable notice when practicable.
3. SMS program terms (A2P)
Program name: LatchCRM Messaging (LatchCRM.live)
Program description: Transactional and conversational texts from licensed agents or the agency about insurance inquiries you initiated or consented to — for example speed-to-lead follow-up, appointment scheduling, quote status, and policy-related reminders. Messages are sent on behalf of agency users through LatchCRM.live.
Message frequency: Varies. You may receive several messages while an agent is helping you schedule or complete a review; frequency depends on your conversation and the agency's workflow. Consent is not a condition of purchase.
Message and data rates may apply. Check your carrier plan for details.
Opt out: Reply STOP to cancel. You can also use STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. After you opt out you will receive a confirmation and no further marketing/program texts from that number (except any legally required notices). Reply START to resubscribe.

4. Accounts & acceptable use
Agency users must provide accurate registration information, keep credentials secure, and use the service only for lawful insurance-related business. You may not use LatchCRM to spam, harass, violate TCPA/CAN-SPAM or carrier rules, scrape data you do not own, or attempt to access another agency's records. We may suspend accounts that create legal, security, or carrier-compliance risk.
5. Agent / agency responsibilities
Agents and agencies are responsible for licensing, disclosures, consent capture, and the content of communications they send. Latch provides software tools; agencies remain responsible for how they use them with consumers.
6. Fees
Agencies pay a SaaS seat subscription (Solo / Manager / Agency Owner tiers as disclosed in-product). Latch does not take a percentage of issued premium; life insurance cannot. Metered utilities (SMS/voice/email) bill at cost plus platform markup. Lead marketplace purchases are separate prepaid charges. Failure to fund the wallet may result in suspension of metered features.
7. Disclaimers
The service is provided "as is" to the fullest extent permitted by law. Latch does not guarantee uninterrupted availability, carrier delivery of every message, or specific insurance underwriting outcomes. Nothing on the site is legal, tax, or insurance advice for consumers; licensed agents provide product recommendations.
8. Limitation of liability
To the fullest extent permitted by law, Latch and its officers, employees, and vendors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from use of the service. Our aggregate liability for claims relating to the service is limited to the fees paid by the claiming agency to Latch for the service in the three months before the claim.
9. Governing law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules, except where consumer protection laws of your state require otherwise.
10. Changes
We may update these Terms by posting a new version at this URL and updating the effective date. Continued use after changes constitutes acceptance of the updated Terms where permitted by law.
